About Enduring Power of Attorney in ACT
An enduring power of attorney is a legal document that allows you to appoint someone, known as your attorney, the legal authority and power to act for you and to make legally binding decisions on your behalf while you are living.
This power can extend to financial, healthcare, personal care and medical research decisions that affect you.
The power granted to your attorney to manage your affairs can be expressed to come into operation immediately or if you become unable to make decisions due to physical or mental incapacity.
Unlike a general power of attorney, an enduring power of attorney “endures” and remains in force even if you lose mental capacity and can no longer make those decisions yourself , however, such power ceases to be of effect when you die.
The Inherit Enduring Power of Attorney allows you to customise the powers and decisions of your appointed attorney and any joint , substitute or alternate attorney that you may wish to appoint.
